For a law school audience: SAAM is not just about awareness — it is about legal remedies, evidence rules, SOL traps, trauma-informed practice, and Title IX. Fair Housing Month is not just about housing — it is about the state law that now fills the void left by federal rollback, and the VAWA bridge that connects two observances into one coherent campaign.

For a law school audience, the legal profession has a documented sexual harassment crisis, which makes SAAM directly relevant to law students and future practitioners. Future lawyers will encounter sexual assault in their practice — and may encounter it in their workplace.

TITLE IX AND CAMPUS SEXUAL ASSAULT — 2025–2026 STATUS
Title IX 2024 rule — VACATED
The 2024 Title IX Final Rule (which expanded sex-based harassment to include gender identity, dating violence, and lowered the deliberate-indifference standard) was vacated NATIONWIDE on January 9, 2025 by Judge Danny C. Reeves (E.D. Ky., Tennessee v. Cardona). The court found the rule exceeded ED's authority and violated the First Amendment.
Current governing standard: 2020 Title IX regulations
The 2020 regulations (34 CFR Part 106, eff. August 14, 2020) now govern nationwide. A February 4, 2025 Dear Colleague Letter from Acting OCR Director Craig Trainor confirmed enforcement on the basis of biological sex. / For sexual assault specifically under 2020 rules: schools must (1) not be deliberately indifferent; (2) offer supportive measures; (3) have the Title IX Coordinator promptly contact the complainant; (4) follow a grievance process; and (5) for postsecondary institutions: hold a live hearing with cross-examination conducted by each party's advisor of choice.

CLERY ACT AND VAWA CAMPUS PROVISIONS
Clery Act
A consumer-protection law requiring Title IV institutions to: publish an Annual Security Report disclosing campus crime statistics (including VAWA-defined categories of domestic violence, dating violence, sexual assault, and stalking); issue timely warnings; maintain the Campus Sexual Assault Victims' Bill of Rights. The Stop Campus Hazing Act (2024) added hazing-incident data collection beginning January 1, 2025. NEU complies via its Annual Security Report (available on NEU's website annually).
VAWA Campus SaVE Act (2013 VAWA amendment to Clery)
Required schools to adopt primary prevention/awareness programs; bystander intervention; definitions of consent in the applicable jurisdiction; an equitable grievance process; and policy statements on sexual assault, domestic violence, dating violence, and stalking. These obligations apply regardless of where the incident occurred (on/off campus, even abroad) as long as it is reported by a student or employee.
MASSACHUSETTS SEXUAL ASSAULT LAW
Civil SOL — adult survivors: 3 years
G.L. c. 260, § 2A. Three years from the incident. No special tolling for adults beyond standard mental-incapacity/defendant-absence provisions. Massachusetts has NO Adult Survivors Act / lookback window for adult claims. This is an active advocacy gap — a pending bill (S.1038) would eliminate the civil SOL for child sexual abuse entirely.
Civil SOL — childhood sexual abuse: up to 35 years from the act
G.L. c. 260, §§ 4C/4C½ (2014 amendment). 35 years from the date of the act OR 7 years from discovery of the causal harm, whichever is later. The 2014 revival applied to claims against individual perpetrators; institutional third-party liability has been litigated separately.
Criminal SOL — G.L. c. 277, § 63
Enumerated child sexual offenses (G.L. c. 265 §§ 22A, 22B, 22C, 23, 23A, 23B, 24B): may be charged at ANY TIME — but charges filed MORE THAN 27 YEARS after the offense require independent corroborating evidence (not exclusively mental-health professional opinions). / Adult forcible rape (G.L. c. 265, § 22) and assault with intent to rape (§ 24): 15-year limit. / For victims under 16: clock does not start until victim turns 16 or the offense is reported, whichever is earlier.
October 1, 2024 — Consent loophole closed
Gov. Healey signed a law closing a 'consent' loophole that had hindered prosecution of doctors and clergy for sexual assault.
MA Rape Shield Law — G.L. c. 233, § 21B
Bars evidence of a victim's sexual reputation and specific instances of sexual conduct in sexual-offense proceedings. Narrow exceptions: (1) victim's sexual conduct with the defendant; (2) recent conduct explaining a physical feature/condition; (3) evidence whose exclusion would violate defendant's constitutional rights. Requires an in-camera hearing, written motion, and offer of proof. *Commonwealth v. Jacques*, 494 Mass. 739 (2024): confirmed the statute covers sexual abuse by a third party and 'does not distinguish between willing and unwilling sexual conduct.'
Trauma-informed practice for lawyers
Trauma impairs memory consolidation and retrieval — survivors may give inconsistent accounts not from dishonesty but from trauma's physiological effects. Lawyers representing survivors need to: use open-ended, non-leading questions; go at the client's pace; document corroboration beyond testimony; prepare clients for cross-examination dynamics; understand rape shield protections and their limits; work with expert witnesses on trauma's effects on memory and behavior. The Human Trafficking Institute's 'Trauma-Informed Lawyering: Prioritizing the Survivor' and the VRLC's practice guides are the standard references.
FEDERAL FAIR HOUSING ENFORCEMENT — WHAT HAPPENED IN 2025–2026
AFFH Rule — terminated
Secretary Turner: 'Terminating this rule restores trust in local communities.' Sequence: Biden 2023 proposed rule withdrawn January 16, 2025 (90 FR 4686); Secretary Turner announced termination February 26, 2025; HUD published Interim Final Rule (90 FR 11020, March 3, 2025, eff. April 2, 2025) reverting to a pre-1994 self-certification standard — grantees self-attest that they take 'any action … rationally related to promoting fair housing.' Sen. Warren and Rep. Waters condemned the rollback.
FHIP grants terminated — 78 grants cut
On February 27, 2025, HUD terminated 78 FHIP (Fair Housing Initiatives Program) grants — jeopardizing $30 million in congressionally authorized funding for 66 fair-housing organizations across 33 states, 'at the direction of DOGE.' Four fair-housing groups sued: *Massachusetts Fair Housing Center v. HUD* (filed March 13, 2025, D. Mass.). TRO issued by Judge Richard G. Stearns (D. Mass.) on March 26, 2025 reinstating funding. As of June 2026, funding remains precarious.
Disparate impact rule — proposed repeal
On January 14, 2026, HUD published a proposed rule to repeal its FHA 'discriminatory effects' (disparate-impact) regulation (comments due February 13, 2026). This follows Executive Order 14281 ('Restoring Equality of Opportunity and Meritocracy,' April 23, 2025) directing agencies to eliminate disparate-impact liability. *Texas DHCA v. Inclusive Communities* (SCOTUS, 2015) still recognizes disparate-impact claims as a matter of statute — private and state enforcement continue.
HUD FHEO staffing and guidance
HUD proposed a 76% staffing cut to its Fair Housing and Equal Opportunity (FHEO) office. HUD withdrew 8+ FHEO guidance documents (Federal Register, April 6, 2026). By May 2025, HUD had closed at least 115 federal fair housing cases without resolving them (per ProPublica).
The result — in one quote
Sasha Samberg-Champion, National Housing Law Project special counsel for civil rights (Shelterforce, May 5, 2026): 'To the greatest extent, the federal government is out of business for fair housing and lending. The Department of Justice Civil Rights Division is gone, HUD [Office of] Fair Housing … [and] Equal Opportunity is gutted.'
WHAT REMAINS: MASSACHUSETTS FAIR HOUSING LAW (G.L. c. 151B)
MA G.L. c. 151B — broader than federal FHA
Prohibits discrimination in housing based on: race, color, religious creed, national origin, sex, sexual orientation, gender identity, age (40+), disability, ancestry, marital status, veteran/military status, and SOURCE OF INCOME (Section 8 and other housing vouchers). The FHA does not protect source of income federally — Massachusetts law does.
Source of income discrimination in MA
It is illegal under G.L. c. 151B to refuse a housing voucher (Section 8/MRVP/AHVP), RAFT, HomeBASE, or emergency rental assistance, or to advertise 'no Section 8.' Enforcement: AG Andrea Joy Campbell's Civil Rights Division (617-963-2917). Havens Realty Corp. v. Coleman (1982) supports tester standing for fair-housing organizations.
Sexual harassment in housing = FHA sex discrimination
A landlord who sexually harasses a tenant, requires sexual favors in exchange for housing (quid pro quo), or creates a hostile housing environment based on sex commits sex discrimination actionable under the FHA and G.L. c. 151B. Complaints may be filed with MCAD, HUD FHEO, or in state/federal court.
Nuisance ordinances — NHLP warning
Local 'nuisance ordinances' penalize properties based on police calls — which disproportionately punish domestic violence and sexual assault survivors who call for help. NHLP (National Housing Law Project, nhlp.org) has documented this trap extensively. Lawyers representing survivors should investigate whether local nuisance ordinances apply and whether they constitute FHA retaliation.
Disability: reasonable accommodations vs. modifications
Housing providers must grant reasonable accommodations (changes to rules/policies/services — e.g., service/emotional-support animal exceptions to 'no pets') and permit reasonable modifications (physical changes — e.g., grab bars, ramps) unless undue hardship or fundamental alteration. The FHA's 'Mrs. Murphy' exemption (owner-occupied ≤4 units) does not apply under G.L. c. 151B for buildings with 3+ units.
NFHA 2025 Fair Housing Trends Report — key statistics
Released November 5, 2025 (nationalfairhousing.org). 32,321 complaints filed in 2024: disability 54.6%; race 15.58%; sex 7.13%; national origin 5.68%. Retaliation complaints more than doubled: 234 (2023) → 472 (2024) — the highest recorded level. Private nonprofit fair-housing organizations processed 74.12% of all complaints.
VAWA 2022 HOUSING PROTECTIONS — THE BRIDGE BETWEEN SAAM AND FAIR HOUSING
No eviction based on survivor status
Housing providers using federal assistance may not evict or terminate assistance based solely on the applicant/tenant being a survivor of domestic violence, dating violence, sexual assault, or stalking.
Emergency transfer rights
Survivors may request an emergency transfer to another unit or property — including where a sexual assault occurred on the premises within the prior 90 days, or where the survivor reasonably believes they are in imminent danger of harm.
Lease bifurcation
Providers may bifurcate a lease to evict the perpetrator while allowing the survivor to remain in the unit.
Confidentiality
Information shared by a survivor about their status may not be disclosed without consent (with law-enforcement exceptions).
HUD FHEO complaint process
VAWA 2022 directed HUD to enforce these protections through the Fair Housing Act complaint process. A lawyer can file a VAWA 2022 complaint with HUD's FHEO office (still operational, though significantly reduced). HUD-5380/5381/5382 are the model notice/transfer-plan/certification forms (revised June 2025). HUD announced its first VAWA 2022 settlements in September 2023.
Important limitation
VAWA housing protections apply only to federally assisted housing (HUD-funded, public housing, HCVs/Section 8, HOME-funded, etc.). Private market housing is not covered by VAWA housing provisions — G.L. c. 151B protections apply there.
